1. Introduction

Clearplay Inc. ("Clearplay," "we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website clearplay.com (the "Site"), use our browser extension (the "Extension"), or use our legacy hardware products.

A Critical Note on Our Privacy Architecture:

We distinguish between data collected on our marketing Site and data processed by our Extension. We apply a stricter standard of privacy to the Extension to ensure your viewing habits remain private and are never used for advertising purposes.

2. Information We Collect

A. Information You Provide Directly (Account Data)

When you register, purchase a subscription, or contact support, we collect:

  • Identity Data: Name, email address, and account credentials.

  • Billing Data: Payment method details (processed via secure third-party payment processors like Stripe; we do not store full credit card numbers).

  • Customer Support Data: Information you provide when contacting us for help.

B. Information Processed by the Browser Extension (Extension Data)

To provide content filtering, the Extension must interact with the video player on your screen. This data collection is minimized to the "Single Purpose" of filtering.

  • Content Identifiers: The Extension identifies the Title ID or URL of the movie you are watching (e.g., on Netflix or Disney+) to retrieve the correct "Filter Files" from our servers.

  • Playback Timestamps: The Extension reads the current time of the video player locally to execute skips and mutes with millisecond precision.

  • Authentication Token: A secure token to verify your active subscription.

  • Local & Ephemeral Processing: The Extension analyzes page content (DOM) locally on your device. The Extension does not scrape, record, or transmit the video or audio streams to our servers.

C. Information Collected Automatically on the Website (Site Data)

When you browse clearplay.com, we use cookies and tracking technologies to collect:

  • Device Data: IP address, browser type, operating system.

  • Usage Data: Pages visited, referral sources, and interaction with our marketing materials.

  • Advertising Identifiers: Pixels (e.g., Meta Pixel, AdRoll) used to measure the performance of our ads. This applies only to the Site, never the Extension.

3. How We Use Your Information

4. Google Chrome Web Store Disclosures

In strict compliance with the Google Chrome Web Store User Data Policy, Clearplay certifies the following regarding data collected by the Extension:

  1. Limited Use: Our use of information received from Google APIs will adhere to the Chrome Web Store User Data Policy, including the Limited Use requirements.

  2. No Sale to Third Parties: We do not sell Extension Data to data brokers, information resellers, or advertising platforms.

  3. No Creditworthiness Checks: We do not use user data for lending or credit scoring purposes.

  4. Permission Justification: The Extension requests permission to 'Read and change all data' on all websites for broad compatibility, but it specifically performs the filtering on supported streaming websites. This is strictly necessary to:

    • Read: Detect the exact timestamp of the video.

    • Change: Perform the "mute" or "skip" command into the video player.

5. Data Sharing and Third Parties

We do not sell your personal information. We share data only with service providers who help us operate:

  • Cloud Infrastructure (e.g., AWS): To host our API and Filter Files.

  • Payment Processors (e.g., Stripe): To handle billing securely.

  • Customer Support Tools (e.g., Zendesk): To manage your help tickets.

  • Analytics & Advertising Partners (Site Only): Providers like Google Analytics or Meta may access Site Data to help us optimize our website. They do not have access to your viewing history or Extension Data.

6. Your Rights (GDPR, CCPA, & Global)

Depending on your location, you have specific rights:

  • Right to Access: Request a copy of the data we hold about you.

  • Right to Deletion: Request that we delete your account and associated data.

  • Right to Correction: Update incorrect personal information.

  • Right to Opt-Out (California/CPRA): You may opt-out of the "sharing" of your Site Data for cross-context behavioral advertising by adjusting your cookie preferences or using a global privacy control.

  • Do Not Track: Our Site honors valid "Global Privacy Control" signals.

7. Data Retention and Security

  • Security: We use industry-standard encryption (TLS/HTTPS) for all data in transit. Sensitive billing data is tokenized.

  • Retention: We retain account data as long as your subscription is active and for a period thereafter as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. We retain technical logs for a limited period for debugging, after which they are deleted or anonymized.

8. Children's Privacy

Clearplay is a tool for families, but the Account Holder must be at least 18 years of age. Individuals under the age of 18 may use the Service only with the involvement and consent of a parent or legal guardian, under the Account Holder's supervision.We do not knowingly collect personal data directly from children under 13 without parental consent. If you are a parent and believe we have inadvertently collected data from a child, please contact us for immediate deletion.
